£4 million dishonest claim dismissed following MIB investigation
Motor Insurers’ Bureau (MIB) has successfully reversed a high-value claim brought under the Untraced Drivers’ Agreement, reinforcing its commitment to protecting funds for genuine victims of road traffic incidents.
The claim, which arose following an incident involving an untraced driver, grew to approximately £4 million and included costs for long-term care, loss of earnings and ongoing disability.
Working closely with legal partner Keoghs, MIB carried out a detailed investigation, including surveillance and comprehensive evidence review. This identified clear inconsistencies between the claimant’s reported limitations and their actual day-to-day activities, including evidence of physically demanding work and running a business.
The court found the claim to be fundamentally dishonest and dismissed it in full, marking the largest decision of its kind under the Untraced Drivers’ Agreement.
MIB is now taking steps to recover interim payments made during the claim.
John Reynolds (Controller Strategic Partnerships) & Sundeep Sindhu (Large Loss Specialist) at MIB said: “This outcome sends a clear message that dishonest claims will not succeed. Our role is to ensure the fund is there for people who genuinely need support after being injured by uninsured or untraced drivers. By rigorously investigating claims where the evidence doesn’t align, we help protect both the integrity of the system and the insurance‑paying public.”
Paul Baxter, Partner and Deputy Business Unit Director at Keoghs added: “This is a significant decision and reflects the strength of collaboration and detailed investigation. By identifying clear inconsistencies in the claim, we were able to support MIB in successfully defending what had become a substantial and fundamentally dishonest case.”
MIB remains committed to identifying and challenging dishonest claims to ensure funds remain available for genuine victims of uninsured and untraced driving and to minimise the impact of fraud on honest motorists.
